日前，海南出台《海南自由贸易港免税商品溯源管理暂行办法》，对免税商品物码溯源系统建设、溯源码的规划和推广应用、再次销售防控等免税商品溯源管理体系建设进行统一规范。

A few days ago, Hainan promulgated the Interim Measures for the Traceability Management of Duty-Free Commodities in Hainan Free Trade Port, which regulates in an integrated manner the building of article code traceability system for duty-free goods, and the building of traceability management system for the planning, promotion and application of traceable source codes and prevention and control of resale of duty-free goods in the Hinan Free Trade Port.

什么是离岛免税商品溯源码？

So what is the traceability code for offshore duty-free products?

溯源码是免税商品的唯一标识，包含“海南离岛免税商品溯源码”字样、防伪二维码、海南免税专属LOGO，以及“关税未付、禁止倒卖”警示语。溯源码加贴在离岛免税商品最小包装单元上，具有防撕毁破坏功能，即使揭底也能留痕保留溯源信息。免税经营企业通过物码溯源系统申请溯源码号段，并关联企业信息，系统生成溯源码后发放给免税经营企业。企业在入库环节加贴溯源码并激活，在销售环节从海关监管系统关联商品名称、经营主体、经营门店、销售、提货等信息。

The traceability code is the only identification of duty-free goods, which contains the words "Traceable source code for Hainan offshore duty-free goods", anti-counterfeiting QR code, exclusive LOGO for Hainan’s duty-free goods, and the warning terms "Duty unpaid, scalping prohibited". The codes are labels attached onto the smallest packaging unit of offshore duty-free goods, which is tear-proof, hence the traceability information can be retained even if the label is peeled off. A duty-free operator should apply for their own number segment of traceable source code through the article code traceability system, and register company information, then the system will generate the traceable source code and distribute it to the duty-free operator. The traceable source codes, which should be pasted to the commodities and activated upon entry into the warehouse, would add in commodity name, operating company, operating store, sales, delivery, and other information in the sales link to the customs supervision system.

Hainan Free Trade Port

第一章、总 则

Chapter I. General Provisions

第一条 为落实《海南自由贸易港建设总体方案》有关风险防控要求，加强对免税商品的管理力度，根据《中华人民共和国海南自由贸易港法》等相关法律法规、规章和政策规定，结合我省实际情况，制定本办法。

Article 1 To fulfill relevant requirements for risk control and prevention in the Master Plan for the Construction of Hainan Free Trade Port, strengthen management of duty-free commodities, in accordance with the Hainan Free Trade Port Law of the People’s Republic of China and relevant laws, regulations and policies and practical conditions of Hainan, the Measures are formulated.

第二条 海南自由贸易港免税商品物码溯源系统建设、溯源码的规划和推广应用、再次销售防控等免税商品溯源管理体系建设适用本办法。

Article 2 The Measures shall apply for the building of article code traceability system for duty-free commodities, and the building of traceability management system for the planning, promotion and application of traceability codes and prevention and control of resale of duty-free commodities in the Hainan Free Trade Port.

第三条 海南自由贸易港免税商品溯源管理体系是指采集记录免税商品进口、流通、消费等环节信息，实现来源可查、去向可追、责任可究，强化全过程质量安全管理与风险控制的管理制度。

Article 3 The traceability management system for duty-free commodities in the Hainan Free Trade Port is the management mechanism that is applied to collect, record the information of import, distribution, consumption and other links of duty-free commodities, for the purpose of checking origins, tracing whereabouts, identifying liabilities and enhancing whole-process quality safety management and risk control.

第四条 免税商品是指离岛免税商品和岛内居民消费的“零关税”进境商品。

Article 4 Duty-free commodities refer to offshore duty-free goods and goods imported at zero-tariff and consumed by residents within Hainan Island.

第五条 海南自由贸易港免税商品溯源码(以下简称溯源码)，是免税商品的唯一标识，包含免税标志和商品溯源功能，采用防撕毁破坏设计，揭底后留痕。

Article 5 A traceable source code for a duty-free commodity in the Hainan Free Trade Port (hereinafter referred to as source code) is the only ID for a duty-free commodity, that involves a duty-free logo and the traceability funtion with tear-proof design which could leave marks on the commodity even when it is peeled off.

第六条 海南省人民政府商务部门负责物码溯源系统建设，以及溯源码设计和推广应用。

Article 6 The commerce administration of the Hainan Provincial People’s Government shall be responsible for the building of article code traceability system for duty-free commodities, and the building of traceability management system for the planning, promotion and application of source codes.

海关、公安机关、财政、大数据管理以及承担市场监管执法职责的部门依照各自职责，配合做好免税商品溯源管理相关工作。

Customs, public security, financial, big data management authorities and the department responsible for market regulation shall play the supporting role of traceability management of duty-free commodities in accordance with their own responsibilities.

免税经营企业应当落实免税商品溯源管理的市场主体责任，负责建设企业信息系统。

Duty-free operators should take on the responsibility as market players in traceability management of duty-free commodities, and be responsible for building the corporate information system.

第二章、物码溯源系统管理

Chapter II. Management of Article Code Traceability System

第七条 物码溯源系统部署在海南省电子政务云上，通过省政务信息资源共享交换平台实现与海南社会管理信息化平台和海关监管系统的数据共享和交换。

Article 7 The article code traceability system is built on the Hainan e-government cloud, and realizes data sharing and exchange with the Hainan social management information platform and the customs supervision system through the provincial government information resource sharing and exchange platform.

第八条 物码溯源系统由海南省人民政府大数据管理部门进行管理及维护，大数据管理部门对平台各端用户进行权限管理，并从数据安全、网络安全、隐私安全及存储安全等多维度保障数据安全。

Article 8 The article code traceability system is managed and maintained by the big data management authority of the Hainan Provincial People’s Government, who shall manage users at various ends of the platform by granting different user rights, and guarantee data security in multiple perspectives including data security, internet security, privacy security and storage security.

第九条 大数据管理部门应建立数据保密制度，未经海南省人民政府、海关总署同意，不得向第三方提供或共享免税商品溯源数据。

Article 9 The big data management authority should establish the data confidentiality mechanism and should not provide or share traceability data of duty-free commodities to any third party unless approved by the Hainan Provincial People’s Government and the General Administration of Customs.

第三章、申请、加贴溯源码

Chapter III. Applying for and Attaching Source Codes

第十条 免税经营企业通过物码溯源系统申请溯源码号段，并关联企业信息。系统生成溯源码后发放给免税经营企业，同时将数据实时传输至海关监管系统。

Article 10 Duty-free operators should apply for their own number segments of source codes and register company information through the article code traceability system, which shall generate the source codes and distribute them to duty-free operators, and shall transmit data to the customs supervision system in real time.

第十一条 免税经营企业应当在免税商品最小包装单元上加贴溯源码。

Article 11 Duty-free operators should attach source codes to the smallest packaging unit of offshore duty-free goods.

第四章、溯源码管理

Chapter IV. Management of Source Codes

第十二条 溯源码激活过程中，免税经营企业应当确保溯源码与免税商品及商品信息正确关联，实现“一物一码”。

Article 12 Duty-free operators should ensure the correct link between the source code and the duty-free commodity and one code for one article.

溯源码在销售环节进行信息关联时，企业销售系统自动对溯源码进行校验，确保溯源码安全使用、溯源码编号真实及编号数与入库数一致；销售端绑定所需数据由海关监管系统按照必要、最小化原则提供，确保数据来源唯一、真实可靠。

While the source code is used to connect information in the sales link, the corporate sales system shall automatically verify the source code to ensure the safe use, the correct numbering of source codes, and that the number of source codes matches the number of commodities entering the warehouse. The data provided to sales terminals shall be provided by the customs supervision system according to the least, necessary information principle to ensure the source of data is unique, authentic and reliable.

如发生溯源码印刷不清晰、标签损坏、商品退货或其他关联失败的情况，免税经营企业应登录物码溯源系统进行解绑、作废及补领，并注明解绑或作废原因。

In case of unclear printing of source code, damaged label, product return or data linking failure, the duty-free operators should log on the article code traceability system to unbind, invalidate or reclaim the codes, and indicate reasons for unbinding or invalidation.

溯源码激活、商品解绑、补领及作废等环节信息，均需通过物码溯源系统上传，确保溯源码使用过程数据完整。

The activation, unbinding, reclaiming and invalidation of source codes should be uploaded through the article code traceability system to ensure data completeness in the whole process of using source codes.

第十三条 在免税商品流通过程中，免税经营企业应妥善保护溯源码标签不被故意损毁、污染，确保溯源码可被有效读取。如有不慎损毁，应当及时更换新的溯源码标签。

Article 13 During the circulation of duty-free commodities, the duty-free operators should properly protect the source code labels from being intentionally damaged or contaminated to ensure that the source codes can be effectively read. In case of accidental damage, a new source code label shall be replaced in time.

第十四条 海关、公安机关以及承担市场监管执法职责的部门通过手持查询设备和海政通移动端应用，登录后扫描溯源码查询对应信息。监管部门和手持设备登录时采用手机号加短信动态验证码等安全认证模式，保证查询安全。

Article 14 Customs, public security, financial, big data management authorities and the department undertaking market regulation law enforcement responsibilities shall use handheld devices and Hainan e-government mobile terminal applications to scan and trace the source codes to check corresponding information after log-in. Mobile phone numbers plus SMS dynamic verification codes shall be used when regulatory departments and handheld devices log in to ensure the security of inquiries.

第十五条 违反本办法规定的行为，《中华人民共和国海关法》和《海南省反走私暂行条例》等法律法规已设定处罚规定的，由有关部门依法予以处罚；构成违反治安管理行为的，由公安机关依照《中华人民共和国治安管理处罚法》予以处罚;构成犯罪的，依法追究刑事责任。

Article 15 Acts violating the Measures shall be punished by relevant departments according to law if penalties have been established by the Customs Law of the People's Republic of China and the Interim Regulations on Anti-Smuggling of Hainan Province among other laws and regulations; Acts constituting violations of public security management shall be penalized by the public security agency according to the Public Security Administration Punishment Law of the People's Republic of China; if a crime is constituted, criminal responsibility shall be investigated in accordance with the law.

第五章、附则

Chapter V. Supplementary Provisions

第十六条 本办法具体应用问题由海南省人民政府商务部门会同海口海关负责解释。

Article 16 Specific issues in application related to the Measures shall be interpreted by the commerce administration of the Hainan Provincial People’s Goverment and the Haikou Customs.

第十七条 本办法自印发之日起实施。

Article 17 The Measures shall be implemented upon issuance.
