7月23日，商务部发布《海南自由贸易港跨境服务贸易特别管理措施（负面清单）》（以下简称《海南跨境服贸负面清单》或负面清单），其中列出针对境外服务提供者的11个门类70项特别管理措施，自2021年8月26日起施行。负面清单体现了目前中国内地在跨境服务贸易领域最高水平的对外开放，在某些领域的开放水平甚至超过了中国当初的入世承诺。为帮助大家更好了解有关背景及具体措施的实际意义，我们推出了系列政策解读，今天带来跨境服务贸易负面清单政策解读的第3期。

On July 23, Ministry of Commerce issued the "Special Administrative Measures for Cross-border Trade in Services in Hainan Free Trade Port(Negative List)" (hereinafter referred to as Negative List), which defines 70 special management measures in 11 categories for overseas service providers and will come into effect from August 26, 2021. The negative list reflects the highest level of opening up in the cross-border service trade field in mainland China, and the level of openness in some areas even exceeds China's original WTO commitments. To help you better understand the background and the practical significance of the specific measures, We have published a series of policy interpretations. Today we bring the third part of the Trade Liberalization and Facilitation policy interpretation. Today we bring the third part of the Hainan Free Trade Port's Cross-border Trade in Services Negative List.

七、请问《海南跨境服贸负面清单》和前两个负面清单是怎么样的关系？下一步如何做好向海南之外更大范围的拓展，为服务业扩大开放提供更强的动力？

7. What is the relationship between the Negative List on Cross-border Trade in Services in Hainan and the previous two negative lists? In the next step, how will it be expanded beyond Hainan to provide a stronger driving force for the expansion and opening-up of the service sector?

《海南跨境服贸负面清单》与市场准入负面清单、外商投资准入负面清单有定位上、功能上不同之处。市场准入负面清单适用对象是境内外市场主体，包括内资企业、外商投资企业等各类市场主体市场准入管理的统一要求，只针对境外市场主体的特别管理措施，不纳入市场准入负面清单。外商投资准入负面清单和《海南跨境服贸负面清单》仅仅列出对境外市场主体或者个人的特别管理措施。

The Negative List on Cross-border Trade in Services in Hainan is different from the negative lists of market access and foreign investment access in positioning and functionality. The negative list of market access is applicable to domestic and overseas market players, including domestic-funded enterprises, foreign-invested enterprises and other market players. Special management measures only targeting overseas market players are not included in the negative list of market access. The negative list of foreign investment access and the Negative List on Cross-border Trade in Services in Hainan only list special management measures for overseas market players or individuals. 

按照世贸组织《服务贸易总协定》的有关定义，服务贸易分为4种提供模式，分别是跨境交付模式、境外消费模式、商业存在模式和自然人移动模式。其中，商业存在模式属于投资，其他3种模式统称为跨境服务贸易。外商投资准入负面清单列出了农业、制造业和服务业等各个行业在外商投资方面的特别管理措施，其中商业存在模式的服务提供也纳入了外商投资准入负面清单。而《海南跨境服贸负面清单》列出了境外服务提供者通过跨境交付模式、境外消费模式、自然人移动模式等其他3种模式向海南自由贸易港提供服务的特别管理措施，在这个清单之外的领域，在海南自由贸易港内，对境内外的服务及服务提供者都是一视同仁。

According to the relevant definitions in the WTO General Agreement on Trade in Services, trade in services is divided into four modes of supply, namely, cross-border supply, consumption abroad, commercial presence and movement of natural persons. Among them, the commercial presence mode belongs to investment, and the other three modes are collectively called cross-border trade in services. The negative list of foreign investment access lists the special management measures for foreign investment in various industries such as agriculture, manufacturing and service, and the service supply of the commercial presence mode is also included in the negative list of foreign investment access. The Negative List on Cross-border Trade in Services in Hainan, however, lists the special management measures for overseas service providers to provide services to Hainan FTP through three other modes, such as cross-border supply, consumption abroad and movement of natural persons. In areas not covered in this list, domestic and overseas services and service providers are treated equally in the Hainan FTP. 

《海南跨境服贸负面清单》是跨境服务贸易领域国家发布的第一张负面清单，这一模式在更大范围实施需要把握好节奏和进度，坚持稳中求进工作总基调，稳扎稳打、分步推进。实际上，我们国家在实施外商投资准入负面清单的过程中，首先是2013年在上海自贸试验区率先试点，之后逐步扩大到广东、天津、福建自贸试验区，试点取得经验，模式运行比较成熟之后，经党中央、国务院批准，于2017年出台了首张全国版的外商投资准入负面清单。

The Negative List on Cross-Border Trade in Services is the first negative list issued by the state in the field of cross-border trade in services. To implement this model on a larger scale, it is necessary to control the rhythm and progress well adhere to the general tone of making steady progress so as to achieve steady and step-by-step progress. In fact, during the implementation of the negative list of foreign investment access, China first launched a pilot project in Shanghai Pilot Free Trade Zone in 2013, and then gradually expanded the implementation in free trade zones in Guangdong, Tianjin and Fujian. After gaining enough experience in the pilot zones and achieving relatively mature modes of operation, the first nation-wide negative list of foreign investment access was issued in 2017 with the approval of the CPC Central Committee and the State Council.

Next, we will actively leverage the role of the Hainan FTP as a pioneer, summarize and evaluate the operation of the Negative List on Cross-border Trade in Services in Hainan in a timely manner, and on this basis, study and formulate negative lists of cross-border trade in services in pilot free trade zones, and promote a higher-level institutional opening-up through pilot projects in a wider range, so as to explore new paths and lay a good foundation for nationwide implementation of the management system for negative lists on cross-border trade in services. 

八、跨境服务贸易负面清单即将在海南实施，请问当前海南推进跨境服务贸易发展的总体情况如何？有哪些特色和亮点？

8. The negative list will soon be implemented in Hainan. What is the overall situation in the promotion of cross-border trade in services in Hainan at present? What are the characteristics and highlights? 

近年来在国家部委的大力支持下，海南积极贯彻落实国家的部署，采取了一系列促进跨境服务贸易发展的举措。比如，在跨境交付方面，中国人民银行、银保监会、证监会、外汇局发布了《关于金融支持海南全面改革开放的意见》，明确提升人民币可兑换水平，支持跨境贸易投资自由化、便利化举措。海南印发实施《智慧海南总体方案（2020－2025年）》，海南自由贸易港国际互联网专用通道正式开通。在自然人移动方面，海南制定出台海南自由贸易港外籍“高精尖缺”人才认定标准，开展国际人才服务管理改革试点，发布自贸港境外人员执业管理办法和境外人员参加职业资格考试管理办法、目录清单，开放境外人员参加职业资格考试38项，单项认可境外职业资格219项。在境外消费方面，海南在全国率先启动入境游客移动支付服务便利化试点，推动琼港澳游艇自由行等等。

In recent years, with the generous support of national ministries and commissions, Hainan has actively implemented the national deployment and adopted a series of measures to promote the development of cross-border trade in services. For example, in terms of cross-border supply, the People’s Bank of China, the China Banking and Insurance Regulatory Commission, the China Securities Regulatory Commission and the State Administration of Foreign Exchange issued the Opinions on Financial Support for Hainan’s Comprehensive Deepening of Reform and Opening up, which explicitly proposes to raise the convertibility level of RMB and support the liberalization and facilitation of cross-border trade and investment. Hainan Province has issued and implemented the The Smart Hainan Plan (2020-2025) and officially launched the dedicated channel of Hainan FTP for the Internet. With regard to the movement of natural persons, Hainan Province has formulated and promulgated the accreditation standards for foreign “top-notch and urgently-needed” talent in Hainan FTP, carried out the pilot reform of international talent service management, issued the management measures for overseas personnel practicing in the FTP, and the management measures and catalogues for overseas personnel taking professional qualification examinations for overseas personnel, and launched 38 professional qualification examinations and 219 individually-recognized overseas professional qualifications. As for consumption abroad, Hainan Province has taken the lead in launching pilot projects of mobile payment service for inbound tourists, and promoted self-guided tour by yacht in Hainan, Hong Kong and Macao.

在上述举措的推动下，海南跨境服务贸易呈现良好发展势头。除去年受疫情影响增速下降外，2018年、2019年分别增长16.8％和20.3％，今年上半年更是增长了81.2％。

Driven by the above measures, Hainan’s cross-border trade in services shows a favorable momentum of development. Except for the decline in last year as affected by the epidemic, the growth rate increased by 16.8% and 20.3% in 2018 and 2019 respectively, and increased by 81.2% in the first half of this year. 

海南跨境服务贸易主要呈现以下特点：一是市场关注度大幅提升。2018－2020年，全省注册服务贸易市场主体增加了2.1倍。二是服务贸易结构不断优化。以知识密集和技术密集为特征的新型服务贸易在去年、今年上半年分别增长了1.1倍和1.9倍，占服务贸易比重已提高到66.5％。其中电信、计算机和信息服务已成为增长最快、规模最大的板块。三是特色服务集聚发展效应明显。海南生态软件园、三亚市中医院分别被认定为国家首批数字服务出口基地、中医药服务出口基地。四是形成了可复制、可推广的经验。“优化事业单位对外籍人员的服务和管理”、“将服务贸易管理事项纳入国际贸易‘单一窗口’”入选全国深化服务贸易创新发展最佳实践案例。五是实施服务贸易出口先导性行动计划。2019年海南跨境服务贸易首次实现顺差。六是将跨境服务贸易纳入海南高质量发展考核指标体系。

Hainan's cross-border trade in services mainly presents the following characteristics: First, the market attention has been greatly increased. From 2018 to 2020, the number of registered players of trade in services in the province increased by 2.1 times. Second, the structure of trade in services has been continuously optimized. The new trade in services characterized by knowledge-intensive and technology-intensive increased by 1.1 times and 1.9 times respectively in last year and the first half of this year, accounting for 66.5% of the trade in services. Among them, telecommunications, computer and information services have become the fastest growing and largest sectors. Third, the cluster development effect of characteristic services is obvious. Hainan Resort Software Community and Sanya Traditional Chinese Medicine Hospital have been respectively recognized as the first national digital service export base and the first export base of Chinese medicine service. Fourth, experience that can be replicated and popularized has been accumulated. “Optimizing the service and management of foreign personnel in public institutions” and “including trade in services management issues into the ‘International Trade Single Window’ have been selected as best practice cases for deepening the innovation and development of trade in services in China. Fifth, the pilot action plan for trade in services export has been implement. Hainan’s cross-border trade in services achieved a surplus for the first time in 2019. Sixth, cross-border trade in services has been included in the assessment index system of high-quality development in Hainan Province.

九、《海南跨境服贸负面清单》在领域和范围上有哪些值得关注的亮点？

9. What are the highlights of the Negative List in terms of fields and scope?

第一，在人才政策方面，跨境服贸负面清单实行了更加开放的政策。举几个例子，比如取消境外个人参加注册计量师、勘察设计注册工程师、注册消防工程师等10多项职业资格考试方面的限制，为优秀的境外人才来参与海南自贸港的建设方面提供了便利。

First, in terms of talent policy, the Negative List has adopted more open policies. For example, the restrictions on overseas individuals taking more than 10 professional qualification examinations, such as certified metrology engineers, certified engineers in survey and design, and certified fire protection engineers, have been lifted, providing convenience for outstanding overseas talent to participate in the construction of the Hainan FTP.

第二，在提升运输自由便利化方面，负面清单实施了更加开放的船舶运输政策和航空运输政策，在推动建设西部陆海新通道国际航运枢纽和航空枢纽方面，也将发挥重要作用。比如说《海南跨境服贸负面清单》取消了境外船舶检验机构没有在中国设立验船公司，不得派员或者雇员在中国境内开展船舶检验活动的限制。《海南跨境服贸负面清单》还取消了外国服务提供者从事航空气象服务的限制等。

Second, in terms of improvement in the freedom and convenience of transportation, the Negative List has adopted more open sea transportation and air transportation policies, which will also play an important role in promoting the construction of an international shipping hub and an aviation hub for the new land-sea corridor in the west. For example, the Negative Liston Cross-border Trade in Services in Hainan has cancelled the previous restriction that foreign ship inspection institutions could not employ or send personnel for ship inspection activities in China if they did not set up ship inspection firms in China. The Negative List has also lifted the restrictions on overseas service providers engaging in aeronautical meteorological services.

第三，在扩大专业服务业对外开放方面，也有一些具体举措。比如允许境外律师事务所驻海南代表机构从事部分涉海南的商事非诉讼法律事务，允许海南律师事务所聘请外籍律师担任外国法律顾问和港澳律师担任法律顾问，取消外国服务提供者从事报关业务的限制等。

Third, there are some specific measures to expand the opening-up of professional services. For example, the representative offices of overseas law firms in Hainan are allowed to engage in some commercial non-litigation legal affairs involving Hainan, law firms in Hainan are allowed to employ foreign lawyers as foreign legal advisers and lawyers from Hong Kong and Macao as legal advisers, and restrictions on overseas service providers engaging in customs declaration are lifted. 

第四，在扩大金融业对外开放方面，《海南跨境服贸负面清单》一方面坚持金融服务实体经济，有序推进金融改革创新，另外一方面，也进一步扩大对外开放。比如说，允许境外个人申请开立证券账户或者期货账户，并且可以申请证券投资咨询从业资格和期货投资咨询的从业资格等。

Fourth, in terms of expanding the opening-up of the financial sector, the Negative List on Cross-border Trade in Services in Hainan, on the one hand, insists on finance servicing the real economy and promoting orderly reform and innovation of finance; on the other hand, further expands the opening-up. For example, overseas individuals are allowed to apply for opening securities accounts or futures accounts, and can apply for consulting qualifications for securities investment and futures investment.

十、除了《海南跨境服贸负面清单》之外，商务部还有哪些支持海南服务业发展的具体措施？

10. Apart from the Negative List, what specific measures does MOFCOM have to support the development of Hainan’s service sector? 

习近平总书记指出，海南要以发展旅游业、现代服务业、高新技术产业为主导，大力发展海南省的经济。大力发展服务业，可以说是贯彻习近平总书记重要指示的必然要求。除了通过实施《海南跨境服贸负面清单》来支持海南省服务业的发展，在此之前商务部也公布了一系列的措施来支持海南服务业发展。

General Secretary Xi Jinping instructed that Hainan should vigorously develop the economy with the development of tourism, modern service sector and high-tech sector as the leading factors. Vigorously developing the service sector can be an inevitable requirement for implementing General Secretary Xi Jinping’s important instructions. In addition to the implementation of the Negative List to support the development of Hainan’s service sector, MOFCOM has also released a series of measures to support the development of Hainan’s service sector.  

商务部在支持海南服务业发展方面也采取了一系列的措施。比如说，今年4月份，经国务院同意，商务部印发了《海南省服务业扩大开放综合试点方案》，全国只有北京、上海、天津和重庆，海南是和它们一起来实施试点的；去年8月份，经国务院同意，在海南省开展了全面深化服务贸易创新发展试点；今年4月份，经国务院同意，商务部会同20多个部门印发了《关于推进海南自由贸易港贸易自由化便利化若干措施的通知》，这里面的措施有15项涉及到服务贸易发展；今年5月份，商务部、海南省共同举办了首届中国国际消费品博览会，这也是服务业的重要内容；第五个方面，继续支持指导海南建设国家中医药服务出口基地和数字服务出口基地等。

这些支持海南服务业发展的措施主要可以概括为三个方面：

These measures to support the development of Hainan’s service sector can be summarized into three aspects:

第一方面，优化海南服务业发展的体制机制，完善规则体系，深入推进“放管服”改革。比如说，下放了中资邮轮国际运输相关业务的许可权限，探索取消设立拍卖企业审核许可和商业特许经营备案等，允许举办涉外经济技术展，允许外资银行参与进出口环节税款缴纳和保函业务等。在体制机制方面为海南提供更好的支持。

First, optimizing the systems and mechanisms for the development of Hainan’s service sector, improving the rule systems, and further promoting the reforms to “streamline the government, delegate power, and improve government services”. For example, the licensing authority for international transportation of Chinese-funded cruise ships has been delegated, ways to cancel examination and approval for setting up auction enterprises and the filing of commercial franchising have been explored, foreign-related economic and technological exhibitions have been allowed, and foreign banks have been allowed to participate in tax payment and guarantee business in import and export. Better support has been provided to Hainan in terms of system and mechanism.

第二方面，提升海南服务业发展的便利水平和要素保障。比如说，允许境外专业人士按照有关要求取得国内执业资格和特定的开放领域的就业机会，探索允许符合条件的境外人员担任法定机构、事业单位、国有企业的法定代表人等。境外优秀人才、专业人才可以到海南来从事特定的职业。

Second, improving the convenience and factor guarantee for the development of Hainan’s service sector. For example, overseas professionals are allowed to obtain domestic practice qualifications and employment opportunities in specific open fields according to relevant requirements, and qualified overseas personnel are allowed to serve as legal representatives of statutory institutions, public institutions and state-owned enterprises. Overseas talent and professionals can be introduced to Hainan to engage in specific occupations.

第三方面，探索创新发展模式，推进区域集聚发展，拓展新业态、新模式，推动传统领域转型。比如说，鼓励建设特色服务出口基地，大力发展数字贸易，优化数字贸易的包容审慎监管等。服务业是海南的重点主导产业，商务部将会同海南省以及相关部门，按照党中央、国务院的统一部署，加快推动各项政策举措的落地见效，促进海南自由贸易港高质量的发展。

Third, exploring innovative development models, promoting regional cluster development, expanding new business forms and models, and promoting the transformation of traditional fields. For example, we encourage the construction of special service export bases, vigorously develop digital trade, and optimize the inclusive and prudent supervision of digital trade. Service sector is a key leading industry in Hainan. MOFCOM will work with Hainan Province and relevant departments to accelerate the implementation of various policies and measures and promote the high-quality development of Hainan FTP in accordance with the unified arrangements of the CPC Central Committee and the State Council.
